Terms of Service

1. Acceptance of Terms

By accessing or using Authentic (“the Platform”), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Platform.

2. Description of Service

Authentic is a marketplace that connects AI content creators (“Studios”) with individuals (“Models”) whose likenesses may be used in AI-generated content. The Platform facilitates the licensing of AI-generated images featuring model likenesses through a structured collaboration and approval workflow.

3. User Accounts

You must create an account to use the Platform. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must provide accurate and complete information during registration and keep your account information updated.

Users register as either a Model or a Studio. Each account type has specific rights and obligations as described in these terms.

4. Model Terms

As a Model on the Platform, you:

• Grant Authentic the right to display your profile and reference photos to registered Studios
• Retain full control over which AI-generated images featuring your likeness are approved for licensing
• May set your own per-image pricing (minimum $20 per image)
• May define content restrictions and reject any image for any reason
• Will receive 80% of each license fee for approved and paid images
• Must provide accurate identity verification as required
• May revoke collaboration access from any Studio at any time

5. Studio Terms

As a Studio on the Platform, you:

• Must request and receive collaboration approval from a Model before submitting images
• May access Model reference photos only after collaboration is approved
• Must accurately describe your brand and intended use of images
• Will pay the Model's set price for each approved image
• Receive a commercial license for each paid image, subject to the Model's content restrictions
• Must not use licensed images in ways that violate the Model's stated restrictions
• Must not redistribute, resell, or sub-license images obtained through the Platform

6. Image Licensing

Each licensed image grants the Studio a non-exclusive, perpetual, worldwide license to use the image for commercial purposes, subject to any content restrictions set by the Model. The license does not include the right to create derivative works that would constitute new AI training data.

7. Payments

All payments are processed through Stripe. Studios pay upon licensing approved images. Model payouts are processed weekly with a minimum threshold of $50. Authentic retains 20% of each transaction as a platform fee.

8. Content Guidelines

All content on the Platform must comply with applicable laws. Prohibited content includes but is not limited to: illegal content, content depicting minors, non-consensual content, and content that violates third-party intellectual property rights. Authentic reserves the right to remove any content that violates these guidelines.

9. Intellectual Property

Models retain all rights to their likeness. Studios retain ownership of the AI-generated images they create. Authentic does not claim ownership of any user-generated content. The Platform's branding, design, and software are the property of Authentic.

10. Limitation of Liability

Authentic provides the Platform “as is” and makes no warranties regarding the accuracy, completeness, or reliability of any content. Authentic is not liable for disputes between Models and Studios, except to facilitate resolution through the Platform's built-in review and approval processes.

11. Termination

Either party may terminate their account at any time. Upon termination, existing licenses remain valid, but no new collaborations or license requests may be created. Authentic may suspend or terminate accounts that violate these terms.

12. Changes to Terms

Authentic may update these terms at any time. We will notify users of material changes via email or Platform notification. Continued use of the Platform after changes constitutes acceptance of the updated terms.
